Legal Cash Gifting Programs

With all of the searches online about the legality of cash gifting, the question remains as to whether or not legal cash gifting programs exist. While there are numerous programs and many more websites covering the gifting activity, many of them consider the legitimacy of parts of cash gifting and cover illegally structured organizations.

Many skeptics of cash gifting will often refer to cases that talk about the arrests of people running pyramid or ponzi schemes calling themselves a cash gifting program of some sort. Of course, a lot of these skeptic types often use cash gifting as a way to entice those investigating cash gifting programs or systems to their own online money making program.

As far as I can tell, there are three basic areas of concern when determining whether or not a program is an illegal or legal cash gifting program. They are the structure, sales or promotion and tax liabilities.

Structure

The way an organization promoting cash gifting is structured is a pretty important aspect of any gifting program. Just about everyone involved in cash gifting or some other money making program online has heard horror stories about pyramid scams or some ponzi scheme that has taken money from people only to leave them somewhat bankrupt when the process is over.

We have all heard about Bernie Madoff and his scamming tactics and about how many people lost their savings to this man’s scheme. Just about everyone has heard about a Ponzi scheme, but few know the origins of this business scam.

In the early 20th century, there was an Italian immigrant named Charles Ponzi. Mr. Ponzi found a loophole in postal reply coupons.  You can do your own search on this and find a great deal of information, but basically Mr. Ponzi was able to create a system where you could invest money and get a return based on the loophole that he discovered. What Ponzi ended up doing was gather more money from new investors to pay dividends to the older investors. This model eventually falls in on itself, as was the case with Mr. Ponzi and the Ponzi scheme was invented.

A pyramid scheme is similar to a Ponzi scheme in that it takes in money from newer investors to pay older investors or those that are “higher” in the pyramid. There was a program name Women Empowering Women. This scam was your basic, garden variety pyramid scheme. Empowered women were arrested and there were a lot of women left with nothing, but a bad taste in their mouth.

These schemes and scams described above are exactly that and are, should be in my book, illegal. These have absolutely NOTHING to do with a legal cash gifting program.

Selling and Promoting Cash Gifting

When it comes to the selling and promoting of a cash gifting program, system or activity, people should be wary. Why? Because there are others out there just waiting for you to screw up so they can pounce on you and tell you that you are breaking the law. How would you be breaking the law? If you promote your cash gifting system, whether it be a legitimate program or not, you cannot guarantee results or any type of profit. You also may not call your cash gifting activity an investment or even an opportunity even though that’s exactly what it may be.

I have said it over and over and I will say it again. ANY business opportunity or money generating activity, online or offline, should not guarantee you success. No one can promise your success because of one main flaw in the system. That flaw is the person joining the system. Does that mean that you cannot generate income with a good money making system? Of course not. What you have to understand here is that to market online, one must understand and comprehend how to market online.

Internet marketing is not for the weak or faint of heart. Marketing online is not that difficult, but there are specific skills that must be learned and acquired and this takes time. However, once learned, you can market ANYTHING SUCCESSFULLY online…this includes any MLM, any cash gifting program, anything. And please don’t be confused, marketing does not mean advertising. Advertising is a form of marketing, but you do not want to limit yourself just to an advertising strategy here. When you think of marketing, you want to keep in mind that your main goal should be to get your name or website or both out there in the world for people to see and learn about. Successful marketers learn a great deal about branding their product or image in the “real” world and you need to be able to do the same thing in the virtual world as well.

Promoting a legal cash gifting program requires that you abide by strict rules like never referring to cash gifting as an investment or making money program. Cash gifting is an voluntary activity. You give money to others and you may receive gifts yourself. Nothing is guaranteed. If you are like me, however, you know that the more you give the more you receive and you know this to be a universal law of generating an income.

Taxes

I hear a lot of people online talking about never having to pay taxes because according to the IRS you don’t have to as long as the gift is $13,000.00 or less per year per individual. This includes the person sending the gift as well as the person receiving the gift. Where people may not get this part exactly right is that if they are promoting an activity, including cash gifting, in the same manner that you would promote any business opportunity then you may want to rethink the whole “no taxes due” mentality.

I don’t know for sure if the gifting activity, even a legal cash gifting activity, is exempt from all taxes, my gut feeling is that it is NOT exempt. I would recommend that you sought out a good tax attorney on this issue, that’s what they go to school for, they are paid to give you sound legal advice in this area. As a good, and safe, measure I would simply pay taxes on the revenue that you generate in terms of gifts you receive, this just makes sense. I’m not into giving the government any more money, especially when they cannot take care of the money that they already receive, but I’m not into serious jail time either. You may not go to jail, but if you were found guilty you would definitely receive a nice fine. This is just an area where you are going to have to go and hire an attorney to find out what you need to do.

As you can see, there are a lot of things that one needs to consider when you are looking for a legal cash gifting program. One of the main things you should consider is a mentor. I love cash gifting for a variety of reasons. I love the simplicity and at times the controversy. I love helping people that are looking to do something to better their lives and lifestyles. Being invited to a cash gifting program is a fantastic opportunity in many respects, but you need to make sure that the person inviting you knows how to teach and train you. If you do not get that then you are probably doomed.
